These Terms and Conditions (the “Terms”) govern your use of the HUNGARYKUM website and any purchase you make through it. The site is operated by:

Throughout these Terms, “HUNGARYKUM”, “we” and “us” refer to Hungarykum Kft. The online store is hosted on Shopify; Shopify provides the store platform and processes checkout data on our behalf.

By browsing the site, creating an order or completing a checkout you confirm that you have read, understood and accepted these Terms. If you do not accept them, please do not use the site.

We may update these Terms from time to time. The version published at the moment your order is placed is the version that applies to that order.

You must be at least 18 years old, or the age of legal majority in your country, and able to enter into a binding contract in order to place an order.

Orders may be placed as a private consumer or as a business. Where you order as a business, statutory consumer rights such as the 14-day withdrawal right do not apply.

HUNGARYKUM fragrances are extrait de parfum compositions produced in small batches. Because they are made in limited runs from natural and natural-derived materials, minor variation in colour, sediment or intensity between batches is normal and is not a defect.

Our bottles are hand-made porcelain. Small irregularities in glaze, decoration and finish are characteristic of hand production and are part of the object.

Scent descriptions, note pyramids, accord charts and longevity indications are artistic and indicative. Perception and longevity differ from person to person depending on skin type, climate and application, so they are not a guarantee of performance.

Photographs are intended to represent the products faithfully, but screens render colour differently and images are not a warranty of exact appearance.

Product listings are an invitation to order, not a binding offer. Your order is an offer to buy. A contract is formed only when we send you an order confirmation or dispatch the goods, whichever happens first.

We may decline or cancel an order, before or after confirmation, where:

• the item is out of stock or the batch has sold out;
• a price or description was published with an obvious error;
• payment is declined, reversed or flagged by our payment provider;
• we suspect fraud, resale abuse or bulk ordering for unauthorised distribution;
• delivery to your address is restricted by transport rules for alcohol-based goods.

If we cancel a paid order, we refund the full amount to the original payment method.

Prices are shown in the currency displayed at checkout and include applicable VAT unless the checkout states otherwise. Shipping is calculated and shown before you confirm payment.

For deliveries outside the European Union, import duties, customs charges and local taxes may be levied on arrival. These are set by the destination country and are payable by you as the recipient; they are not included in our prices.

We may change prices at any time. Changes do not affect orders already confirmed.

Checkout and payment are processed through Shopify, our e-commerce platform, and its integrated payment providers. Card data is entered on their secure systems and is never stored on our servers.

Goods remain our property until payment has been received in full. Risk of loss passes to you on delivery.

Orders are prepared and dispatched from Hungary. Handling normally takes a few business days; limited editions and pre-orders may take longer, in which case the listing says so.

Delivery estimates are estimates, not guaranteed dates. Delays caused by carriers, customs, weather or force majeure are outside our control.

Perfume is classified as a flammable liquid for transport. Some destinations, carriers and air services restrict or prohibit it, so certain countries or shipping methods may be unavailable at checkout.

Please inspect the parcel on arrival. If it is visibly damaged, note this with the carrier where possible and contact us within 7 days with photographs.

If you are a consumer in the European Union, you may withdraw from your purchase within 14 days of receiving the goods, without giving a reason. To do so, inform us clearly in writing before the period expires.

Return the goods within 14 days of notifying us. Return shipping costs are borne by you unless the item was faulty or incorrectly supplied. We refund the purchase price, including standard outbound shipping, within 14 days of receiving the return or proof of return.

Condition of returned goods. The fragrance must be unused, unopened and with any seal intact. For reasons of hygiene and product safety, sealed goods that have been opened cannot be returned. You are liable for any loss of value resulting from handling beyond what is needed to establish the nature and characteristics of the product.

Discovery sets and samples are supplied so that you can test a fragrance before committing to a full bottle; opened samples are excluded from the withdrawal right on the same hygiene grounds.

Your statutory rights regarding non-conforming goods are unaffected by these Terms. If an item arrives damaged, leaking, incomplete or different from what you ordered, contact us with your order number and photographs and we will arrange a replacement, repair or refund.

Damage caused by misuse, dropping, exposure to heat or direct sunlight, or by decanting into another container is not covered.

Our fragrances are alcohol-based and flammable. Keep them away from open flame, heat and direct sunlight, and store them out of the reach of children.

For external use on skin and clothing only. Do not swallow, do not spray into the eyes, and discontinue use if irritation occurs. If you have sensitive skin or a known allergy to fragrance materials, test on a small area first. Allergen information is available on the packaging and on request.

If you create an account, you are responsible for keeping your credentials confidential and for all activity that takes place under it.

You agree not to:

• use the site for unlawful, fraudulent or misleading purposes;
• scrape, crawl or harvest content, images or pricing at scale;
• attempt to probe, bypass or disrupt the security of the site;
• resell products as an unauthorised retailer or present yourself as an official stockist;
• upload content that is unlawful, defamatory or infringing.

The HUNGARYKUM name, the stag emblem, bottle designs, folk-art motifs, photographs, fragrance texts, layouts and code on this site are protected by intellectual property law and remain our property or that of our licensors.

You may view and share our pages for personal, non-commercial purposes. Any other use — reproduction, adaptation, commercial republication or use in training datasets for commercial models — requires our prior written permission.

Our Reviews page features content created independently by third parties and embedded from external platforms. Their opinions are their own and do not constitute claims made by HUNGARYKUM. Embedded media is delivered by those platforms and subject to their terms.

If you submit content to us, you grant us a non-exclusive, royalty-free licence to display it in connection with the brand, and you confirm that you own it and that it does not infringe anyone’s rights.

Links to boutiques, partners and other websites are provided for convenience. We do not control those sites, their stock, prices or policies, and purchases made there are governed by their own terms.

We aim to keep the site available and accurate, but we do not guarantee uninterrupted access. We may suspend, withdraw or change any part of the site for maintenance or business reasons without notice.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded — including a consumer’s statutory rights.

Subject to that, our total liability arising from an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss such as lost profit or lost opportunity.

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including supply shortages of raw materials, carrier disruption, customs action, strikes, fire, flood, epidemic, war or failure of public networks.

These Terms are governed by Hungarian law. Consumers resident in the EU keep the protection of the mandatory rules of their own country of residence and may bring proceedings there.

We would always prefer to resolve a complaint directly, so please contact us first. EU consumers may also use the European Commission’s online dispute resolution platform.

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
